INPI informs that the ceremony took effect on December, 13 at São Francisco de Assis Church and it was joined by “authorities, wine producers and their relatives” -- the organization of the winemakers is mostly family who, many of them, are descendants of migrants. INPI also noted that “the first migrants arrived in the region in 1877, starting a tradition of grapes and wines that strengthened over 136 years. However, the former stood out more than the latter”.
Ms M Nunes, INPI’s representative, observed that “combining innovation and tradition, you are on the path of sustainable development”.
Aprobelo brings together 11 wineries and received an Indicação de Procedência (Indication of Source/Origin).

El pasado 10 de diciembre de 2013 se celebraron los primeros 20 años del Instituto Mexicano de la Propiedad Industrial (IMPI). El IMPI es el organismo encargado de administrar el sistema de propiedad industrial en México.
En 1991 se promulgó la Ley de Fomento y Protección de la Propiedad Industrial que generó la creación del IMPI como un organismo público descentralizado con personalidad jurídica y patrimonio propio. Sin embargo, fue hasta el 10 de diciembre de 1993, cuando se publicó en el Diario Oficial de la Federación el decreto por el que se creó el IMPI.
En estas dos décadas, el IMPI ha consolidado su presencia en toda la República Mexicana, a través de sus cinco oficinas regionales ubicadas en Nuevo León, Guanajuato, Puebla, Yucatán y Jalisco, además de sus oficinas centrales en la ciudad de México.
Para conmemorar el 20º aniversario del IMPI, la Lotería Nacional para la Asistencia Pública ha puesto a la venta un billete de lotería billete de lotería con un premio de 10 millones de pesos en dos series. El sorteo será el próximo 18 de diciembre de 2013.
El IMPI también ha sido noticia recientemente por su integración al proyecto TMclass y por la puesta en marcha de la Búsqueda Figurativa de Marcas en Línea.
Desde el pasado 11 de diciembre de 2013 y en el marco de la cooperación entre el IMPI y la Oficina de Armonización del Mercado Interior (OAMI), el IMPI se ha convertido en la primera oficina de América Latina que se incorpora al proyecto TMclass desarrollado por la OAMI.
El proyecto TMclass tiene como objetivo facilitar al usuario la clasificación de productos y servicios a los que pertenece una marca, siendo una herramienta útil que ayudará en la presentación de marcas y a organizar productos y servicios en la clase correcta.

In the event, the Court of Appeals confirmed the decision and admitted evidence that showed that the opponent's mark had indeed been used intensively in the Province of San Juan (and also elsewhere) for a quarter of a century, having won several prizes during that period.
According to the Court of Appeals, even an unregistered mark deserves the protection of the law “at least through the application of the general principles of law” and in certain cases through the application of Article 953 of the Civil Code, which considers that acts carried out in bad faith, as well as acts contrary to good practices and morals, are null and void.

In this particular news the Colombian National Radio and Television ( RTVC ), commissioned by the Colombian Ministry of Labour , offered to the cycling star and peasants’ idol Nairo Quintana , to be the image of a campaign. The proposed campaign forms part of the new ‘Pacto Agrario’ (Agricultural Pact) run by the Government. At first Mr Quintana agreed but later on his manager Mr Libardo Leyton rejected any involvement with the campaign due to the cyclist’s image right being committed to Movistar (Nairo Quintana rides for the Movistar team). Movistar is one of the biggest mobile phone operators in Latin America, using its brand in more than 10 Latin America countries and operating under other brands in other countries. Does it mean that he cannot be the image of any other campaign? He is the image of a phone/telecommunications industry and what he has been approached for is a popular campaign for the people in the agricultural business, specifically farmworkers.
It is then presumed that his contract with the Movistar team has granted ‘exclusive’ rights to the mobile phone company. Yet, it is questionable the wide range of this said contract….binding another person (i.e. his father) who is not a party on the contract and who appeared not to know about this. OR..perhaps..well… this area is Greek to me.
Anyways, Nairo Quintana appears to be happy with the Movistar team since cycling news reports that Nairo will stay with Movistar for 2014 and Nairo’s brother Dayer will be joining the team.

Por su parte el Instituto Federal de Acceso a la Información y Protección de Datos ha dado a conocer, en un comunicado de fecha 7 de noviembre del presente año que “…prácticas como esta merecen una acción inmediata de las diversas autoridades responsables y la rigurosa aplicación de la ley por el daño que representa a la privacidad de quienes, de buena fe, confían a otros --instituciones, particulares o empresas-- su información personal, que sólo puede recibir tratamiento controlado y legítimo”.
La divulgación de estos datos, así como su recolección, presumiblemente no cuentan con el consentimiento de cada uno de los afectados, lo que supone una violación de proporciones significativas a la reciente Ley Federal de Protección de Datos Personales en Posesión de los Particulares, así como al Código Federal de Instituciones y Procedimientos Electorales ya que dichos datos, pudieron haber sido transferidos por personal de las autoridades o de las empresas privadas encargadas del manejo de dicha información.
La página Web responsable ha sido dada de baja por el momento (http://www.buscardatos.com), sin embargo, la divulgación no afectaba únicamente a ciudadanos mexicanos sino que, además, contenía datos de ciudadanos de Argentina, Chile y Paraguay.

Mr. Brandelli is a career diplomat expert and an IP expert, having previously being the chief of the Intellectual Property Department of the Ministry of the International Relations. Recently he had been serving in Montevideo, Uruguay, as a member of the permanent delegation to MERCOSUR and ALADI, two regional agreements. Widely known as a sensitive person to the balance of protection of IP Rights in developing countries, the new Commissioner was present at the discussions about the enactment of the current Industrial Property Law of 1996. Mr. Brandelli is also one of the responsible for the "agenda for the development" that Brazil and Argentina presented at WIPO in 2006.
It is still hard to foresee how this will impact the development of the IP, especially the patent system, the law and practice in Brazil. However, it is undeniable that changes will be expected upon Mr. Brandelli assuming the office.

A worthy remark was made by INPI’s president who highlighted that it was important to overthrow “the myth that protecting intellectual property is available to large companies only”. He continues asserting that “protection is vital for micro and medium enterprises”.

The claimant was the Chilean company dedicated to airline operations -- merged in 2010, LAN Chile Airlines TAM Brazil Airlines (for more information re. this merge see previous post here). The report submitted by the claimant shows that the company is the largest airline companies in Latin America and the tenth globally. The claimant runs its business under the brand LATAM, which is a registered trade mark in many jurisdictions as well as having a CTM (no. 9351271 ) in classes 35 , 37, 38 and 39 the International Classification. Moreover, they argued that the trade mark has significant reputation at least in Chile, where both the claimant and defendant are located. Moreover, it was claimed that the defendant did not hold any right or legitimate interest in the domain name and so, tried to take unfair advantage of LATAM’s reputation. Furthermore, the defendants had registered the domain name in bad faith. The claimant also added that during correspondence with the defendant, in order to reach an amicable settlement, the defendant demanded payment of USD 6,000 in order to transfer the domain name and to end the dispute. All of these factors fulfilled the requirements established in the Uniform Domain Name Dispute Resolution Policy (UDRD).
The defendant, Mr Maximiliano Arriagada was a Chilean citizen residing in Chile. As a civil engineering and business entrepreneur, he noted as an argument that he was “developing a business plan”, a project which was based on the development of an Internet portal specifically aimed at Latin America. He selected the ‘latam’ word as a commonly used word to identify the region of Latin America. He also argued that the request of USD 6,000 made to the claimant was a normal commercial negotiation after the claimant made an initial offer of USD 1,000. It was also acknowledged that while the project was developed, the domain name was connected to a website operated by Godaddy.com which included a number of advertising links to websites which offer products and services to third parties.
The panel ordered the domain name
a)The domain name was identical or confusingly similar to the claimant’s trade mark;
b) the defendant did not hold any rights or legitimate interests in respect of the said domain name; and
c) domain name was being used in bad faith.

Cachaça is a distilled spirit made from sugarcane juice, usually used as an ingredient in tropical drinks – caipirinha being one of the most well-known cocktail. This is the second GI granted to Cachaça in Brazil.
Nivaldo Gonçalves das Neves, Apacs’ president, notes that such recognition will prevent falsification of the drink and will allow consumers to have greater security at the time of consumption; moreover, it will promote regional progress. The recognised GI will start to circulate from January 2014.

Indeed, TRIPS does define the objective to be attained and it is for member countries to establish their procedures. At the moment proposals to amend the Paten Law are on their way – specifically to this case, one of the proposal is to revoke Article 40 of Law No. 92790, since Article 33 of the TRIPS only requires that “The term of protection available shall not end before the expiration of a period of twenty years counted from the filing date.” Therefore, there is no requirement for patent term extensions to compensate for delays.

The Cariri Paraiba was awarded an Indicação de Procedência (Indication of Source), a type of GI that refers to the name of the place that has become recognized as producing a producr or service – in this particular case the good in question is ‘handmade lace’
The cities that comprise the geographical boundaries of the said GI are: Congo, Prata, Sumé, Monteiro, Zabelê, Camalaú, São Sebastião do Umbuzeiro e São João do Tigre. The Conselho das Associações, Cooperativas, Empresas e Entidades vinculadas a Renda Renascença do Cariri Paraibano (CONARENDA) is the entity responsible for the GI.
CONARENDA’s president, Ms Nubia Pinheiro said the Association intends now to use ‘labels’ indicated the GI granted.

El debate de la denominación de origen del Pisco viene de muchos años atrás, ambos países se han estado disputado el uso exclusivo del nombre. Los chilenos, argumentan que ellos logran una mayor producción de la bebida y un mayor consumo, sin embargo, han sido más países los que le han dado la denominación de origen a Perú.

Today, I received the ‘Revista da Propiedade Industrial’ (IP magazine) No 2230, 01 October, 2013 and guess what?! INPI granted yet another GI for a national product. This time, an Indicação de Procedência (Indication of Source) was approved for wine producers in the region of Belo Monte. The certificate is granted to wine producers in the said region represented by the Associação dos vitivinicultores de Monte Belo do Sul (APROBELO).
In reality, I do not think this has something to do with the forthcoming events. According to the magazine Globo Rural, this project started in 2008 when 12 winemakers from Belo Monte felt inspired by the “success of the Vale dos Vinhedos in Bento Gonçalves” the only Brazilian region that at the time did have a GI certificate (an Indication of source and later on, a denomination of origin).
Indeed, the granting of another GI to a wine is not to be taking as a bombshell. In particual, INPI informs that in the Belo Monte region the “wine industry represents more than 90% of the agricultural production" which counts for "40% of the municipal GDP".
